Analysis of the enforcement status of the 2nd FlugLSV (Aircraft Noise Protection Regulation)

The aim of the project is to determine the state of implementation of the 2nd Aircraft Noise Protection Regulation (FlugLSV). The 2. FlugLSV regulates in particular the reimbursement of structural noise abatement measures for dwellings and facilities requiring protection that are located in the vicinity of an airport, as well as the noise abatement requirements for their construction. The prerequisite for this is the designation of noise protection areas in accordance with the Aircraft Noise Protection Act (FluLärmG). In 2017, as stipulated by the FluLärmG, the law itself and the other ordinances such as the 2nd FlugLSV were to be evaluated. However, since the designation of noise protection areas had been delayed and, accordingly, the claims for structural noise protection measures, it was not possible to determine a fully comprehensive picture at that time. This project now closes this gap and surveys the enforcement status of the 2nd FlugLSV nationwide. In addition to the legal requirements for structural noise abatement, voluntary programs exist at some airport locations that also provide structural noise abatement. These programs are also taken into account.
