abstract = {The policy brief examines why the Nagoya Protocol has not yet consistently delivered fair and equitable access and benefit-sharing (ABS) from the perspective of provider countries. Based on expert interviews and an international survey, it highlights persistent challenges, including uneven national implementation, unequal bargaining power and difficulties monitoring compliance with benefit-sharing agreements. The brief recommends strengthening national ABS frameworks, ensuring meaningful participation of Indigenous Peoples and Local Communities, and improving transparency and cross-border enforcement. It outlines concrete actions for provider states, user states and users to translate negotiated commitments into verifiable benefits and support biodiversity conservation.},
